Terms of Service

These Terms govern your use of the websites and services of PRECEDE (“we,” “us”), including the PRECEDE platform (precedefire.com) and the EmberCheck service (embercheck.homes). By using our sites or services, you agree to these Terms. If you don't agree, don't use them.
1. Eligibility
You must be at least 18 years old and able to form a binding contract.
2. What our services do — and don't do
EmberCheck and PRECEDE provide wildfire-risk information: scores and early warnings based on environmental conditions, intended to help you prepare. They are informational and supplemental only. They are not a fire-detection, emergency-response, or evacuation service, and they are not a guarantee that any particular fire will or will not occur or be detected. Conditions can change rapidly and data can be incomplete or delayed. Always follow the instructions of local authorities and emergency services. Never rely on EmberCheck or PRECEDE as your sole source of safety information.
3. Accounts
EmberCheck uses a secure email sign-in link. You're responsible for keeping access to your email account secure and for activity under your account.
4. Subscriptions, billing, and cancellation (EmberCheck)
EmberCheck is offered at $19.99/month or $199/year. Paid plans renew automatically until cancelled. You can cancel anytime from your account; cancellation stops future charges, your access continues through the end of the current paid period, and fees already paid for the current period are non-refundable except where required by law. We may change prices with advance notice; changes apply to future billing periods. A free preview is available without a paid subscription.
5. Acceptable use
Don't misuse the services: no unlawful use, no interfering with or attacking the services, no scraping or bulk extraction, and no attempts to reverse-engineer, copy, or derive our models or methods.
6. Intellectual property
The sites, services, scores, content, and the underlying models and methods are owned by PRECEDE and its licensors and are protected by law. We grant you a limited, personal, non-transferable right to use the service for your own use. (Enterprise and agency customers of PRECEDE are governed by their separate written agreements, which control in case of conflict.)
7. Disclaimers
The services are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, timely, or error-free.
8. Limitation of liability
To the fullest extent permitted by law, PRECEDE and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of property, injury, or damages arising from wildfire or from your reliance on the services. Our total liability for any claim relating to the services will not exceed the amount you paid us in the 12 months before the claim.
9. Indemnification
You agree to indemnify and hold PRECEDE harmless from claims arising out of your misuse of the services or violation of these Terms.
10. Termination
We may suspend or end access for violation of these Terms or to protect the services or other users.
11. Changes
We may update these Terms; continued use after changes means you accept them.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.
